Practice documents can be obtained from the main building of the Ministry of Public Works in South Surra: Area (4), Third floor, Documents and Contracts Department, from: 11 AM to 2 PM.
1- Practice Conditions:
a. This is a general practice for local companies registered in the Central Agency for Public Tenders and specialized in the relevant field of this practice. The capital of the practice should not be less than (1 million Kuwaiti dinars), and any company that does not meet this condition shall be excluded.
B- Tenders shall be submitted in one envelope (financial only) in accordance with the provisions of Article (15 paragraphs first) of the law and the terms of the practice, provided that the tender includes the initial insurance and is valid for a period of 90 days from the closing date and in accordance with the terms of the practice.
c- The bids shall be awarded at the lowest prices. The prices for the submitted bids are not final and will be publicly negotiated in one session with all practitioners in accordance with the provisions of Article (11) of the Executive Regulations of the Public Tenders Law.
2- Practitioner Conditions:
a- The practitioner must acquire previous experience in the relevant field of the practice (pipe extension works as well as previous experience in operating and maintaining pumps) and what proves all the capabilities required to carry out the work. Alternatively, the practitioner nominates a subcontractor who is accredited to the Ministry of Public Works and specialized in some of the work of this practice. Any bid that does not fulfill this condition shall be excluded.
b- The practitioner shall not have been subjected to the penalty of deletion from the record or denial of participation under Article 85 of Law 49 of 2016 regarding public tenders; and is still in the penalty period or his grievance has not been accepted by the practice closing date. Any practitioner who does not meet this condition shall be excluded.
c- The Ministry has the right to exclude any practitioner at any stage of the practice if the data or the documents submitted by the practitioner were proven to be incorrect.
d- The Practitioners shall update the information provided to the Ministry of Public Works before submitting the bid.
e- In the case of an epidemic breakout, the practitioner must abide by and implement any instructions, orders, requests or laws issued by the government or the competent medical or healthcare authorities for the purpose of treatment or overcoming the epidemic at his own expense.
3- The final bidding date is 2 PM and the location is specified above.
4- The practitioner must provide 2 copies of all submitted documents, including all practice documents and other documents required to be submitted with the bid signed and sealed, in addition to the original CD delivered from the Ministry signed and sealed.
5- The above fees are collected in the Financial Affairs Department at the ground floor of the Ministry of Public Works main building in South Surra. In the case of purchasing the practice documents and paying the prescribed fees, requests to recover the fees will only be accepted if the practice is canceled in accordance with the provisions of Article 55 of the Public Tenders Law.
6- The practice documents are purchased under a letter of authorization for the practitioner’s representative.
7- Practice is indivisible.
8- Alternative proposals shall not be accepted.
9- Certificate of National Employment Percentage, issued by Ministry of Social Affairs and Labor and valid for one year, shall be provided when submitting the bid.
10- Bid envelopes shall be opened in an open session in the presence of the bidders or their representatives.
11- This announcement is considered as an invitation for the practitioners who want to attend the envelope opening session. Companies that want to attend the session shall coordinate with the Document and Contracts Department before the session date. The following documents must be submitted:
a- Copy of the civil ID (in the case of a non-Kuwaiti, his residence must be set at the company participating in the practice).
b- Copy of the signature authorization from the Central Agency for Public Tenders.
c- In the case that a person other than whose signature is authorized attends the meeting, a written authorization letter to attend the meeting must be obtained from the person whose signature is authorized by the Central Agency for Public Tenders.
12- Owners of small and medium enterprises are excluded from the prescribed fees for purchasing documents in accordance with Article 39 of Law No. 74 of 2019 regarding amendments to the Public Tenders Law No. 49 of 2016.
13- Owners of small and medium enterprises who want to apply for the practice must attach a valid certificate issued by the National Fund for Small and Medium Enterprises Sponsorship and Development with their bid, including an approval thereof as a small or medium enterprise.
14- This announcement is indivisible from the practice documents.
